1. What is an Excavation License?

An excavation license, also known as a contractor's license or a digging permit, is a legal authorization granted to individuals or companies to conduct excavation work in a specific jurisdiction. This license is typically required to ensure compliance with safety regulations and to protect underground utilities, infrastructure, and the general public during excavation activities.

Excavation licenses are required whenever an excavation or underground work is planned within the Town’s right of way. The specific requirements and regulations for obtaining an excavation license can vary depending on the jurisdiction. However, in general, the process may involve the following:

3. What are the Requirements for an Excavation License?

• Review the Nantucket Bylaws (c.127-128) and the Appendix to Road Opening and Excavation Permit – “Jackie’s Law” (520 CMR M.G.L. c. 82A) for your reference. 
• Review and understand the requirements of Chapter 200 Street Opening Regulations 
• A performance bond of $10,000.00 is required in check or insurance 
• Relevant licenses/certification required for you and/or your crew 
• Certificate of Insurance naming the Town of Nantucket 16 Broad St., Nantucket, MA 02554 as additionally insured for Commercial General Liability and Umbrella Liability Coverage of $100,000.00 per person and $300,000.00 per claim (M.G.L 82A, §2). 
• Three (3) professional references from other Towns or Municipalities for first time applicants 
• The Licensed Excavator will submit opening and blocking permits on behalf of their client. If any additional information is required, it will be requested on a case-by-case basis. 
• Excavation licenses must be renewed yearly by June 30 

 

4. Safety

• Traffic control plans should be developed in accordance with the guidelines provided by the Massachusetts Department of Transportation (MassDOT). Proper traffic control measures must be implemented to protect both workers and motorists. 
• This includes: 

• Setting up appropriate signage, barricades, cones, and flaggers to guide traffic safely through the construction zone. Please follow all safety regulations and guidelines in the construction zone. 
• Install clear and accurate signs to inform the public of ongoing construction work. 
• Provide advanced notice of construction zones to allow drivers ample time to react. 
• List detours and alternative routes, if necessary, to minimize traffic disruptions. 
• Ensure that the signage is spaced according to work zone safety regulations for maximum visibility and effectiveness. 

5. How long does the License process take?

Allow for 5-10 business days. 

6. Permit Cost and Duration

• The fee for the license is $200 per Fiscal year.

• This permit is valid for one year.
